This Privacy Policy (the “Policy”) describes the privacy practices for TheKitchenSpot.com (the “Site”), including the following:

What Types of Information Do We Collect?

While using our Site, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you, such as your full name, phone number, email address, or mailing address. When placing orders through our Site, we may ask you to provide us with your financial account information or other personally identifiable information relevant to processing your order. We will retain such personally identifiable information only for as long as it is needed to fulfill the purpose for which it was collected or as required by law.

We may also collect your email address from you if you sign up for emails and exclusive offers through our Site. If you create an Account on our Site, we collect your username and password. Through your Account, you may also provide your full name, billing and shipping addresses, and/or payment information. When you communicate with us, we may retain your communications to process and respond to them.

In addition to information that we collect from you directly, we may also receive information from you from other sources, including third parties, business partners, our affiliates, or publicly available sources.

Surveys & Contests

From time-to-time our Site requests information via surveys or contests. Participation in these surveys or contests is completely voluntary and you may choose whether or not to participate and therefore disclose this information. Information requested may include contact information (such as name and shipping address), and demographic information (such as zip code, age level). Contact information will be used to notify the winners and award prizes. Survey information will be used for purposes of monitoring or improving the use and satisfaction of this Site.

Orders

We request information from you on our order form. To buy from us, you must provide contact information (like name and shipping address) and financial information (like credit card number, expiration date). This information is used for billing purposes and to fill your orders. If we have trouble processing an order, we’ll use this information to contact you.

In addition to the uses described above, we may use the information that we collect about you or that you provide to us, including personally identifiable information:

What Information Do We Share and With Whom

As permitted by law, we may share your information with our affiliates, subsidiaries, or divisions and with their respective officers, directors, employees, accountants, attorneys, and agents, as necessary for us to continue to provide you with our products and services and defend our legal interests. Finally, in the event that we sell, transfer or otherwise share some or all of our assets in connection with a merger, reorganization or sale of assets, or in the event of bankruptcy, your personally identifiable information may be one of the assets transferred. Your Access to and Control Over Information

You may opt out of future contacts from us at any time by using the Contact Us details at the end of this Policy. Upon your reasonable request, we will allow you to:

  • Change/correct any incorrect personally identifiable information we have about you.
  • Have us delete any personally identifiable information we have about you, to the extent that information is not needed by us for legal or regulatory purposes.
  • Express any concern you have about our use of your personally identifiable information.

Security

We take reasonable and appropriate precautions to protect your personally identifiable information. Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure manner. While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information provided to us by you through this Site. The computers/servers in which we store personally identifiable information are kept in a secure environment. Despite these and other commercially reasonable measures, we cannot guarantee the security of information collected through this Site.

The safety and security of your personally identifiable information also depends on you. Where we have given you, or where you have chosen, a password to access certain parts of our Site, you are responsible for keeping this password confidential.

Cookies

We use “cookies” on this Site. A cookie is a piece of data stored on a site visitor’s hard drive to help us improve your access to our Site and identify repeat visitors to our Site. For instance, when we use a cookie to identify you, you would not have to log in a password more than once, thereby saving time while on our Site. Cookies can also enable us to track and target the interests of our users to enhance the experience on our Site. We may also collect log data, which may include information such as your computer’s Internet Protocol (IP) address, browser type, browser version, the pages of our Site that you visit, the time and date of your visit, the time spent on each page of our Site and other statistics. We may use this information to identify trends in usage of our Site. In general, we do not link your IP address to any personally identifiable information you provide. You may disable certain cookies by activating the appropriate settings in your browser.

Third-Party Service Providers

We use third-party partners to perform business-related functions on our behalf. Examples of these partnerships include customer service, credit card payment processing, fraud checking, order delivery, delivery of email or postal mail, marketing assistance, search listing and links (including online paid search), and data analysis. In order to perform these functions, third-party service providers may have access to the personally identifiable information that you provide to us, but the third-party service providers are prohibited from using it for purposes other than those necessary for the services they provide to us. These companies do not retain, share, store or use personally identifiable information for any secondary purposes beyond filling your order or providing other relevant services on our behalf.

We use Kibo Software, Inc.’s (“Kibo”) Order Management Software to organize, manage, and process orders on our Site. Specifically, Kibo processes all payments made through the Site. The Site may request certain personally identifiable information (including name, billing address, credit card number, expiration date, and security code) necessary for Kibo to process the payment transaction. The payment transactions, including Visa, MasterCard, American Express, and PayPal transactions, are processed solely by Kibo. The Kitchen Spot does not have access to full credit or debit card numbers as a result of the payment transactions processed by Kibo. We use Google Analytics and Google Tag Manager to collect statistical data and manage e-marketing tags to add functionality into the Site, including analytics of the Site’s usage. We use Google Maps API to allow you to locate dealers in your area. We also use Google’s reCAPTCHA widget on the Site to prevent spam and bot requests on our Site. Our Site may also be integrated with social media networks and other platforms (i.e. Facebook, Instagram, Pinterest, Twitter) whereby information may be shared between us and those platforms.

Online Tracking

This Site is configured so that it does not track users who update their browser settings or signals of tracking preferences to remain anonymous, which may include “Do Not Track” instructions. “Do Not Track” is a web browser setting that seeks to disable the tracking of individual users’ browsing activities. If, however, a user is logged into a customer-created account on the Site, the user will be tracked through that account, regardless of the Do Not Track setting.

This website contains links to and media or other content from other sites. Due to the dynamic media capabilities of this Site, it may not be clear to you which links are within the Site and which are to external sites. If you click on an embedded third-party link, you will be redirected away from our Site and to the third-party site. You can check the URL to confirm that you have left this Site.

This Policy is only applicable to this Site and does not apply to any third-party sites. We encourage our users to be aware when they leave our Site and to read the privacy policies of any other site that collects personally identifiable information. If you visit a third-party site and/or provide any personally identifiable information on such site, it will be governed by that third party’s privacy policy. We are strongly committed to protecting the privacy of children. This Site is not intended for use by children under the age of 18. We do not knowingly request or collect personally identifiable information from any child under the age of 18. If you are under the age of 18, do not use the Site or provide us with any information about yourself, such as your name, telephone number, email address, or any screen names or usernames you may use for social media or other sites. If we learn we have collected or received personally identifiable information from a child under the age of 18 without verification of parental consent, we will delete that information.
